CIDB Prompt Payment Regulations

The CIDB Prompt Payment Regulations are proposed amendments to the regulations under South Africa’s Construction Industry Development Board Act 38 of 2000. The draft would set a payment due date no later than 30 days from invoice, void ‘pay-when-paid’ and ‘pay-when-certified’ clauses, require reasoned withholding notices, allow contractors to suspend work for non-payment, and establish a fast-track adjudication process. First anticipated around 2013 and republished after legal criticism that they might be ultra vires, they remain unenacted as of the latest vault evidence — a reform stalled for over a decade.
