Open Questions: Free State capture (Magashule, Zwane, Estina)

1. Magashule trial outcome: The R255m asbestos trial resumed March 2, 2026 with all 18 accused including Moroadi Cholota. When is the trial expected to conclude? Has the state presented its full case? Are any accused seeking plea deals?

   Status: Unresolved as of April 2026. Trial actively underway. No reported plea negotiations. Magashule has said he will “speak the truth” and testify. Trial was originally scheduled to run April–June 2025 but was extended by the Cholota extradition dispute. A conviction date is not foreseeable before late 2026 at earliest.

2. Estina trial reinstatement: The Bloemfontein High Court struck the Estina/Vrede case off the roll August 7, 2024. The NPA obtained a reinstatement in June 2025. What is the current status of the reinstated trial? Has a new trial date been set?

   Status: Unresolved as of April 2026. No confirmed new trial date found in research. Trial reinstated June 2025 but scheduling as of April 2026 unknown.

3. Gupta extradition and Estina: The Guptas (Atul, Rajesh) remain in the UAE. Estina was a direct Gupta vehicle. Has South Africa formally requested extradition of Gupta family members in connection with Estina? Has the UAE cooperated?

   Status: Unresolved. UAE extradition treaty was signed but implementation is stalled. No Gupta extradition on Estina-specific charges has been reported. The broader Gupta extradition saga is ongoing through diplomatic channels as of April 2026.

4. Magashule’s Gupta connections beyond Estina: Magashule’s alleged asbestos gratification included a payment via Refiloe Mokoena (“Gupta ally”). What was the extent of Magashule’s direct financial relationship with the Gupta family — beyond the Mokoena intermediary?

   Status: Partially answered. Mokoena connection is the documented link in the asbestos indictment. No further direct Magashule–Gupta financial transactions have been publicly documented in court records or commission testimony as of April 2026.
