Act 36 of 1947
The Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act 36 of 1947 is the primary piece of legislation governing the pest control industry in South Africa. Any person who applies pesticides for reward or in the course of a business must hold a PCO registration certificate from DALRRD in one or more approved fields. This creates the foundational legal moat for the industry: operators without registration are operating illegally, and legitimate commercial customers (especially in food handling and healthcare) will not award contracts to unregistered PCOs.
The Pest Control Operator Regulations under Act 36 of 1947, first gazetted on 18 February 2011, established the certification and CPD framework. The 2011 regulations also introduced the principle that restricted agricultural remedies may only be used by registered PCOs, a principle formalised in new regulations published on 25 August 2023. This 2023 amendment tightened the compliance barrier and effectively expanded the list of products that require a licence to apply. The CPD renewal system — requiring PCOs to accumulate points over a three-year cycle — imposes a recurring compliance cost and creates attrition risk for small, under-resourced operators.
The Act is administered by the DALRRD Directorate of Agricultural Inputs Control (AIC), and South African Pest Control Association is formally commissioned by government under this Act to maintain minimum standards of practice and knowledge. This dual-track enforcement (government registration + industry association standards) creates a layered compliance environment that benefits well-organised large operators over fragmented sole traders. Sections 10 and related regulations set out the PCO registration process; section 10 specifically requires individual operator registration — not just company registration — which means staffing decisions have direct regulatory implications for pest control businesses.
